Privacy Policy

in the company ENGO CONTROLS S.C. with its registered office in Pszczyna (43 – 200), Górnośląska 3E, holding the Tax Identification Number (NIP): 6381846397 and the Polish Business Registry Number (REGON): 389921661.

The terms used in this Privacy Policy have the following meaning:

  1. Privacy Policy – it should be understood as this document, i.e. the Privacy Policy in force at ENGO CONTROLS S.C. in Pszczyna.
  2. Personal Data Controller (PDC) – a natural or legal person, public authority, unit or other entity, which, independently or jointly, determines the purposes and methods of personal data processing, i.e. in this case of ENGO CONTROLS S.C., in Pszczyna (43-200), Górnośląska 3E, holding the Tax Identification Number (NIP): 6381846397 and the Polish Business Registry Number (REGON): 389921661.
  3. GDPR – Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
  4. Personal Data – information about an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by an identifier such as his/her name, surname, identification number, location data, online identifier or one or more factors specific to his/her physical, physiological, genetic, mental, economic, cultural or social identity.
  5. Processing – an operation or a set of operations which is performed on personal data or sets of personal data, whether or not by automatic means, such as collection, recording, organisation, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transfer, dissemination or otherwise making available, matching or combination, restriction, erasure or destruction.
  6. User – any natural person visiting the Website or using one or more services or functionalities described in the Policy.

This document is intended to show how all information about the users of the website are collected, processed and used. We ensure that all information concerning the Users of our website is used by us in accordance with the binding legal regulations.

1. Data of the Personal Data Controller

2. Purpose and legal basis of your personal data processing

Personal data of all Users of our website, including IP address data and other information collected by cookie files are processed for the following purposes:

1)     To take action at the request of the data subject, prior to the conclusion of the agreement, your personal data shall be processed on the basis of Article 6(1)(b) of the General Data Protection Regulation, should you do so via the contact form made available at the PDC’s website,

2)     In the event of any other personal data processing, in order to respond to an enquiry sent 
via the contact form made available at the PDC’s website, your personal data shall be processed if you have given your consent to such processing, and the legal basis for such processing shall then be Article 6(1)(a) of the General Data Protection Regulation.

3. Cookie files

Cookies are small text files that are saved by a website on an Internet user’s device. On its website, the PDC, as well as other entities, uses cookies, i.e. small text files installed on a computer, phone, tablet or other device of the User browsing the Website. They can be read by our system, as well as by systems belonging to other entities whose services we use (e.g. Google, Facebook). On our website we have the so-called Facebook slider, which allows you to like our fanpage on this website while using the site. However, for this to happen, we must use the cookies provided by Facebook.

Cookies perform many functions on a website, including, among others:

a)     an impact on the processes and performance of your use of the website — cookies are used to make the website operate efficiently and enable you to use the functions available on the website, which is possible, among others, by remembering the settings between visits to the website. They allow to navigate the website and individual subpages efficiently;

b)     session state – cookies often store information about how visitors use the website, such as which subpages they most often display. They also allow to identify errors displayed on some subpages. Therefore, cookies used to store the so-called “session state” help to improve the service and comfort of browsing the pages and to maintain the session state — if a customer logs on to his/her panel, then cookies enable the maintenance of the session. This means that you do not need to re-enter your login and password every time you go to a different subpage, which makes it easier for you to use the website in a comfortable way;

c)     creating statistics – cookies are used to analyse how users use the website (how many of them visit the website, how long they stay, which content is of most interest etc.). This makes it possible to constantly improve the website and adapt it to users’ preferences. 
In order to track the activity and create statistics, we use Google tools, such as Google Analytics; in addition to usage statistics reports, Google Analytics can also help display more relevant content in Google services to the user (e.g. in the Google search engine) and throughout the network, along with some of the cookies described above;

What is important, the content of cookie files does not allow for identification of the user, and cookies are not used to process or store your personal data. The cookie mechanism is not used to collect any information about users.

4. Right to withdraw the consent

If your personal data is processed with your consent, you have the right to withdraw it at any time. 

In order to withdraw your consent just send an e-mail to the following address: 
rodo@engocontrols.com, or click on the link provided at the end of each message. At the same time, we would like to point out that the withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent prior to its withdrawal.

5. Requirement to provide personal data

Providing your personal data is voluntary, however, in some cases it is necessary for us to be able to meet your expectations in terms of using our contact form provided on our website.

6. Automated decision-making and profiling

We kindly inform you that we do not make automated decisions, including those based on profiling.

7. Personal data recipients

The recipients of your personal data are the PDC and representatives of the PDC authorised to process personal data, including, in particular, the entity providing the e-mail hosting service, i.e. nazwa.pl sp. z o.o. in Krakow (70-653), Mieczysława Medweckiego 17, to the PDC.

8. Transfers of personal data to third countries

We kindly inform you that your personal data is not transferred outside the European Economic Area.

9. Retention period of personal data

The retention period of your personal data depends on the purpose and legal basis of the processing:

a)      as regards the processing of your data for the purposes resulting from legitimate interests pursued by the PDC, namely direct marketing, pursuant to Article 6(1)(f) of the General Data Protection Regulation, your personal data shall be processed until you object to the processing of your personal data for the purpose of such marketing,

b)     if your data is processed for the purpose of providing electronic services pursuant to Article 6(1)(b) of the General Data Protection Regulation, your data shall be stored by the PDC until the limitation of any warranty or guarantee claims, for a minimum of 5 years from the beginning of the year following the financial year in which the operations, transactions and proceedings are finally terminated, repaid, settled or time-barred,

c)     as regards the processing of your personal data for the purpose of sending commercial information, until your consent to the processing of personal data has been withdrawn.

10. Right to lodge a complaint

If it is found that the processing of your personal data infringes the provisions of the General Data Protection Regulation, you have the right to lodge a complaint to a supervisory body.

11. Rights of entities whose personal data are processed

We kindly inform you that in accordance with the applicable law, you have the right to access, rectify and delete your personal data – in cases indicated in the provisions of Article 17 of the General Data Protection Regulation. In cases mentioned in Article 18 of the General Data Protection Regulation, you have the right to restrict the processing of your personal data. In cases indicated by the law, you also have the right to object to the processing of personal data. In cases where processing is based on consent or agreement, you also have the right to transfer your personal data.

12. Security of personal data

We would like to assure you that your personal data is processed by the PDC in accordance with the applicable legal provisions, including, in particular, in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation). The PDC carries out risk analyses on an ongoing basis to assess the risk inherent in the processing and has implemented appropriate measures – such as, among others, encryption of the PDC’s website and any connections to minimise this risk. Our website has been encrypted with the use of an SSL certificate, which serves to confirm the owner of the website and to encrypt the communication between the user’s web browser and the server. In addition, the PDC has implemented measures to ensure an adequate level of security, including confidentiality. In assessing the risks of data security, the PDC took into account the risks related to its processing of personal data, including accidental or unlawful destruction, loss, alteration, unauthorised disclosure or unauthorised access to personal data transferred, stored or otherwise processed, and took appropriate measures to prevent their consequences.

13. Final Provisions

1.    In matters not regulated by this Privacy Policy, the provisions on personal data protection  shall apply.
