The terms used in this Privacy Policy document have the following meanings:

Privacy Policy – refers to this document, i.e., the Privacy Policy in force at ENGO Controls Sp. z o.o. Sp. k. in Kobielice.

Data Controller (ADO) – a natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data, i.e., in this case, ENGO Controls Sp. z o.o. Sp. k. in Kobielice (43 – 262), ul. Rolna 4, Tax ID (NIP): 6381806825, Business Registry Number (REGON): 243111228.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

Personal data – information about an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Processing – any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

User – any natural person visiting the Website or using one or more services or functionalities described in the Policy.

This document aims to present the way of collecting, processing, and using all information about the service users. We ensure that all information regarding Users using our service is used in accordance with the applicable legal provisions.

Purpose and legal basis for processing your personal data

Personal data of all Users using our service, including IP address data and other information collected by cookies, are processed for the following purposes:

For the purpose of taking actions at the request of the person to whom the data relates, before concluding a contract your personal data will be processed based on Article 6(1)(b) of the General Data Protection Regulation, in case such actions are taken through the contact form provided on the ADO’s website,

In the case of any other processing of personal data, for the purpose of providing you with a response to a question sent via the contact form provided on the ADO’s website, your personal data will be processed if you give your consent to such processing, the legal basis for such processing of personal data will then be Article 6(1)(a) of the General Data Protection Regulation.

Cookies

Cookies are small text files stored by a website on a user’s device. ADO on its website, like other entities, uses so-called cookies, i.e., small text files, installed on the computer, phone, tablet, or any other device of the User browsing the Service. They can be read by our system as well as by systems belonging to other entities whose services we use (e.g., Google, Facebook). Our website has a so-called Facebook pixel, which allows liking our fan page in this service while using the website. However, to make this possible, we must use cookies provided by Facebook.

Cookies perform many functions on the website, including:

affecting the processes and efficiency of using the website — cookies are used to make the website function smoothly and to use the available functions, which is possible, among others, by remembering settings between visits to the site. Therefore, they allow for smooth navigation on the website and its individual pages;

session state — cookies often store information about how visitors use the website, e.g., which pages are most often displayed. They also enable the identification of errors displayed on some pages. Cookies used to save the so-called “session state” thus help improve services and increase browsing comfort as well as maintaining session state — if the client logs into their panel, cookies allow the session to be maintained. This means that after moving to another page, it is not necessary to re-enter the login and password each time, which contributes to the comfort of using the website;

creating statistics — cookies are used to analyze how users use the website (how many open the website, how long they stay, which content is of the most interest, etc.). This allows for constant improvement of the website and adaptation of its operation to user preferences. To track activity and create statistics, we use Google’s tools, such as Google Analytics; in addition to reporting website usage statistics, the Google Analytics pixel can also be used, along with some of the above-mentioned cookies, to help display more relevant content to the user in Google services (e.g., in Google search) and across the web;

Importantly, the content of cookies does not allow for the identification of the user, and personal data is not processed or stored through cookies. The cookie mechanism is not used to obtain any information about users.

You need to click on the menu (in the upper right corner), Settings tab > Show advanced settings. In the “Privacy” section, you need to click the Content settings button.

Internet Explorer 6.0 and 7.0

From the browser menu (upper right corner): Tools > Internet Options > Privacy, the Sites button. Use the slider to set the level, confirm the change with the OK button.

Mozilla Firefox

From the browser menu: Tools > Options > Privacy. Activate the Firefox program: “will use user settings”. The decision about cookies is made by selecting – or not – the option Accept cookies.

Opera

From the browser menu: Tool > Preferences > Advanced. The decision about cookies is made by selecting – or not – the option Cookies.

Safari

In the Safari drop-down menu, select Preferences and click the Security icon. Here you choose the security level in the “Accept cookies” area.

Right to withdraw consent

If the processing of your personal data is based on consent, you have the right to withdraw it at any time. To withdraw consent, it is enough to send an email to rodo@engocontrols.com, or click on the link included at the end of each message. At the same time, we would like to indicate that the withdrawal of consent does not affect the legality of processing carried out based on consent before its withdrawal.

Requirement to provide personal data

Providing your personal data is voluntary, however, in some cases, it is necessary for us to meet your expectations regarding the use of our contact form provided on our website.

Automated decision-making and profiling

Please be informed that we do not perform automated decision-making, including profiling.

Recipients of personal data

The recipients of your personal data are the ADO and those authorized by it to process personal data on behalf of the ADO, including, in particular, the entity providing the ADO’s email hosting service, namely nazwa.pl sp. z o.o. with its seat in Krakow, ul. Mieczysława Medweckiego 17.

Transfer of personal data to third countries

Please be informed that your personal data is not transferred outside the European Economic Area.

Personal data retention period

The period for retaining your personal data depends on the purpose and legal basis for their processing:

in the scope of processing your data for purposes arising from legally justified interests pursued by the ADO, i.e., direct marketing, based on Article 6(1)(f) of the General Data Protection Regulation, your personal data will be processed until you object to the processing of your personal data for such marketing purposes,

in the case of processing your data for the purpose of providing services electronically, based on Article 6(1)(b) of the General Data Protection Regulation, your data will be stored by the ADO until the expiration of any claims under warranty and guarantee, not less than 5 years from the beginning of the year following the financial year in which the operations, transactions, and proceedings were finally completed, paid, settled, or expired,

in the scope of processing your personal data for the purpose of sending commercial information – until you withdraw your consent to the processing of data,

Right to lodge a complaint

If it is found that the processing of your personal data violates the provisions of the General Data Protection Regulation, you have the right to lodge a complaint with the supervisory authority.

Rights of data subjects

Please be informed that in accordance with applicable law, you have the right to access your personal data, the right to rectify them, and to delete your personal data – in cases indicated in the provisions of Article 17 of the General Data Protection Regulation. In cases indicated in Article 18 of the General Data Protection Regulation, you have the right to restrict the processing of your personal data. In cases provided for by law, you also have the right to object to the processing of personal data. In cases where processing is based on consent or a contract, you also have the right to transfer your personal data.

Personal data security

We would like to assure you that your personal data is processed by the ADO in accordance with applicable law, in particular, in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). The ADO continuously conducts a risk analysis to assess the risk specific to the processing and has implemented appropriate measures – such as, among others, encrypting the ADO’s website and all connections, which minimize this risk. Our website has been encrypted using an SSL certificate, which serves to confirm the owner of the site and encrypt communication between the user’s web browser and the server. Moreover, the ADO has implemented measures to ensure an adequate level of security, including confidentiality. Assessing the risk in terms of data security, the ADO took into account the risk associated with the processing of personal data by it, including such as accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access to personal data transmitted, stored, or otherwise processed and took appropriate measures to prevent effects.

Final provisions

In the scope not regulated by this Privacy Policy, the provisions on personal data protection shall apply.
